Real Estate Rules Take Effect on June 15"},"content":{"rendered":"\n<p><span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1283039935\"><span class=\"aQJ\">This Friday, on June 15, 2018, the<\/span><\/span>&nbsp;<a href=\"http:\/\/listserv.realtorlink.ca\/t\/315924\/6938337\/122752\/44\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/listserv.realtorlink.ca\/t\/315924\/6938337\/122752\/44\/&amp;source=gmail&amp;ust=1526733953727000&amp;usg=AFQjCNH8SApcmK0CWvz7NSO8vo5K2Z9PPw\">new Real Estate Council of BC (RECBC) rules will go into effect<\/a> for all real estate licensees in the <a href=\"https:\/\/www.zolo.ca\/british-columbia-real-estate\">province of British Columbia<\/a>. This is a new B.C. real estate rule that will impact representation in real estate transactions.<\/p>\n\n\n\n<p>In short, these new rules severely restrict or limit the situations where one Realtor can represent both the buyer and the seller in the same transaction. These new rules also stipulate how and when a Realtor must disclose how much commission they are earning and whether or not they will receive any <a href=\"https:\/\/www.zolo.ca\/blog\/what-are-referral-fees\" target=\"_blank\" rel=\"noopener noreferrer\">referral fees<\/a> (fees paid by other professionals as a courtesy for referring a client).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"why-introduce-new-rules-for-disclosure-and-representation?\">Why Introduce New Rules for Disclosure and Representation?<\/h2>\n\n\n\n<p>Whether you are the home buyer or seller, all real estate professionals owe you, their client, a fiduciary responsibility to protect your best interests in the real estate transaction. That means each real estate professional must put your needs and financial well-being ahead of all other factors.<\/p>\n\n\n\n<p>Up until now, there was always a potential conflict of interest between this fiduciary responsibility and an <a href=\"https:\/\/www.zolo.ca\/blog\/how-canada-handles-dual-agency\">agent that represented both sides of the transaction<\/a>. While agents in this position were required to be upfront about this situation (and the potential conflict of interest), there were egregious wrong-doings in recent years that prompted the B.C. provincial government and RECBC to reexamine the role of dual agency in real estate transactions. The result was to severely limit when an agent can represent both the buyer and seller in a real estate transaction in British Columbia.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"new-resources-now-available-about-the-new-rules\">New Resources Now Available About the New Rules<\/h2>\n\n\n\n<p>In order to help buyers, sellers and their agents appreciate, understand and comply with these new rules RECBC collaborated with the UBC Sauder Real Estate Division to develop a new online course, <a href=\"https:\/\/knowledge.recbc.ca\/resource\/rule-changes-agency-and-disclosure-course-1\" target=\"_blank\" rel=\"noopener noreferrer\"><i>Rule Changes: Agency and Disclosure<\/i><\/a>. While the course isn&#8217;t open, yet, all licensees in BC will be required to complete this course as part of their relicensing requirements.<\/p>\n\n\n\n<p>For those that want more information now, RECBC also developed a \u2018one-stop resource shop.\u2019 It\u2019s called the Licensee Knowledge Base, and it\u2019s a user-friendly, searchable resource with information delivered in a variety of formats.
